Privacy Policy (GDPR)

CreativeGrowthHouse ("we", "us"), registered at 60326 Weilburger Strasse 40 A, Frankfurt am Main, Germany, is the data controller for personal data processed through creativegrowthhouse.com and related service communications. We process personal data in accordance with the EU General Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG), and, where applicable, the California Consumer Privacy Act (CCPA).

1.1 Controller & contact

CreativeGrowthHouse, 60326 Weilburger Strasse 40 A, Frankfurt am Main, Germany. Data protection inquiries: [email protected]. You may contact us at any time to exercise your rights listed in section 1.6.

1.2 Categories of data we collect

(a) Identity and contact data you submit voluntarily via our inquiry form or email (name, company, email address, phone number). (b) Project correspondence and statements of work. (c) Technical data such as IP address, browser type, device identifiers, pages viewed, and referrer, collected through essential logs and privacy-conscious analytics. (d) Contract and billing data required to issue invoices and process payments through our payment provider.

1.3 Purposes and legal bases

We process personal data on the following legal bases under Article 6 GDPR: (a) performance of a contract or pre-contractual steps at your request (Art. 6(1)(b)); (b) legitimate interests in operating, securing, and improving our services and responding to business inquiries, balanced against your rights (Art. 6(1)(f)); (c) consent for non-essential analytics cookies and optional marketing communications, which you may withdraw at any time (Art. 6(1)(a)); and (d) legal obligations for tax, accounting, and regulatory retention (Art. 6(1)(c)).

1.4 Recipients and processors

Personal data is shared only with vetted processors acting on our behalf under Article 28 GDPR data processing agreements—including hosting, email delivery, analytics, and payment processing providers—and with professional advisors or authorities where lawfully required. We do not sell personal information within the meaning of CCPA § 1798.140(ad).

1.5 International transfers

Our primary infrastructure is located in the European Economic Area. Where a processor operates outside the EEA, transfers rely on European Commission Standard Contractual Clauses (SCCs) or an applicable adequacy decision, together with supplementary technical and organizational safeguards.

1.6 Retention

Inquiry data is retained for up to 24 months after the last meaningful contact. Contract, invoice, and accounting records are retained for the statutory periods under German law (generally 6–10 years). Data is deleted or anonymized earlier when the purpose is fulfilled and no legal retention obligation applies.

1.7 Your rights

Subject to statutory conditions you have the right to: access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction (Art. 18), data portability (Art. 20), and objection to processing based on legitimate interests (Art. 21) GDPR. California residents may additionally request disclosure or deletion of personal information and exercise the right to non-discrimination. To exercise any right, email [email protected]. You may also lodge a complaint with a supervisory authority, in particular the Hessian Commissioner for Data Protection and Freedom of Information (HBDI), Wiesbaden, Germany.

1.8 Security & children

We apply TLS encryption, access controls, least-privilege practices, and regular backups to protect personal data. Our services are directed at business contacts and are not intended for children under 16; we do not knowingly collect data from children.

Section 02

Terms of Service

These Terms govern engagements between CreativeGrowthHouse, 60326 Weilburger Strasse 40 A, Frankfurt am Main, Germany ("Agency") and its clients ("Client"). By accepting a proposal, statement of work, or purchase order referencing these Terms, the Client agrees to them. Conflicting client purchase-order terms apply only if expressly accepted in writing.

2.1 Services & scope

Services include digital product consulting, web architecture and development, design systems, analytics, and acquisition funnel work as described in the applicable proposal or statement of work (SOW). Any change to scope, timeline, or assumptions requires a written change order. Deliverables not listed in the SOW are out of scope.

2.2 Fees, invoicing & payment

Fixed-fee projects are invoiced according to the milestone schedule in the SOW (typically 40% on kickoff, 40% on design/development acceptance, 20% on delivery). Retainers are invoiced monthly in advance. Invoices are payable net 14 days via bank transfer or the payment link we provide. Late payments may accrue statutory default interest under § 288 BGB and reasonable costs of enforcement. All fees exclude applicable VAT, which will be added where required by law.

2.3 Client obligations

The Client will provide timely access to content, brand assets, credentials, feedback, and decision-makers as reasonably required. Delays in Client inputs extend delivery timelines day-for-day and may incur additional fees if material.

2.4 Intellectual property

Upon receipt of full payment, the Agency assigns to the Client all worldwide rights in the custom deliverables expressly created for the Client under the SOW. The Agency retains rights in its pre-existing materials, frameworks, tools, and know-how, and grants the Client a perpetual, non-exclusive license to any such Agency materials embedded in the deliverables to the extent needed to use them. Third-party components remain subject to their respective open-source or commercial licenses.

2.5 Warranties & liability

The Agency warrants that services will be performed with reasonable skill and care. Except as expressly stated, services and deliverables are provided without other warranties, express or implied. For entrepreneurs and legal entities, liability is limited to damages caused by intent or gross negligence; for ordinary negligence, liability is limited to the breach of essential contractual duties (Kardinalpflichten) and to the foreseeable, contract-typical maximum damage, currently capped at the total fees paid under the affected SOW. Liability under the German Product Liability Act (ProdHaftG) remains unaffected. The Client is responsible for content accuracy, ongoing maintenance, backups, and lawful use of third-party assets.

2.6 Term, termination & suspension

Either party may terminate a retainer with 30 days' written notice at the end of a billing month. For good cause (including material breach left uncured for 10 business days), either party may terminate immediately. Upon termination, the Client pays for all work performed up to the termination date. We may suspend services for invoices more than 30 days overdue after written notice.

2.7 Confidentiality, data & governing law

Each party will protect the other's confidential information with at least the care it uses for its own. Personal data is handled per our Privacy Policy and, where applicable, a data processing agreement. These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants is Frankfurt am Main, provided no mandatory consumer venue applies.

Section 03

Cookie Policy

This Cookie Policy explains how CreativeGrowthHouse, 60326 Weilburger Strasse 40 A, Frankfurt am Main, Germany, uses cookies and similar technologies on creativegrowthhouse.com, in line with the ePrivacy Directive and the GDPR.

3.1 What cookies are

Cookies are small text files placed on your device when you visit a website. They allow a site to remember your actions and preferences over a period of time so you don't have to re-enter them whenever you come back.

3.2 Categories we use

Strictly necessary: session integrity, security, load balancing, and storing your cookie-banner consent choice (localStorage entry cookie_accepted). These do not require consent. Analytics (optional): aggregated, privacy-conscious measurement of page performance and feature usage—activated only after you click "Connect" on the banner or otherwise consent. Functional (optional): remembering preferences such as dismissed notices. Marketing: we do not deploy third-party advertising or retargeting cookies by default on this site.

3.3 Managing your preferences

You can accept or decline optional cookies via the banner controls, clear stored consent by deleting site data in your browser settings, or block cookies entirely in your browser. Blocking strictly necessary cookies may prevent core features such as form submission from working correctly. Browser vendors also provide Do Not Track and Global Privacy Control signals; where technically feasible, we honor such signals for opting out of sale/sharing (we do not sell data) and non-essential analytics.

3.4 Updates & contact

We may update this Cookie Policy when our technologies or legal requirements change; the revision date at the top of the legal center indicates the latest version. Questions: [email protected].

Section 04

Refund & Cancellation Policy

This policy applies to engagements with CreativeGrowthHouse, 60326 Weilburger Strasse 40 A, Frankfurt am Main, Germany, and complements the Terms of Service. Payment processing is available securely via our payment portal.

4.1 Fixed-fee projects

Cancellation before kickoff: full refund of any advance payment within 10 business days to the original payment method. Cancellation after kickoff: payments for work already performed and non-recoverable third-party costs are non-refundable; any prepaid milestone covering undelivered work will be refunded pro rata within 14 business days. Milestone acceptance: each milestone is deemed accepted if the Client raises no material defect notice within 7 calendar days of delivery. Undisputed accepted milestones are non-refundable.

4.2 Retainers

Monthly retainers are billed in advance and are non-refundable once the billing month has started. You may cancel future renewals with 30 days' notice; unused hours do not roll over unless agreed in writing. If we terminate a retainer without cause, we will refund the unused, prepaid portion of the current month pro rata.

4.3 Digital goods & statutory rights

For business clients (Unternehmer), contractual freedom applies as set out above. Where a consumer right of withdrawal exists (e.g., off-premises or distance contracts under § 312g BGB), the 14-day withdrawal right applies as required by law; it does not apply to services already fully performed with the consumer's express prior consent and acknowledgment of waiver, or to clearly personalized goods. Digital content, once downloaded or accessed with consent, may be excluded from withdrawal to the extent permitted by law.

4.4 How to request a refund

Email [email protected] with your invoice number, project name, and reason for the request. We acknowledge requests within 2 business days and decide within 10 business days. Approved refunds are issued to the original payment method; banks may require an additional 5–10 business days to post the credit. Chargebacks filed without first contacting us may pause active work until resolved.
